This policy explains how Fermata Discovery, Inc. (“Fermata,” “we,” “us”) handles personal information collected through fermatadiscovery.com (the “Site”) and when you contact us. It does not cover the VIXN platform. Information our customers process in VIXN is governed by their agreements with us, under which we act as a service provider (processor) on their behalf. Questions about that data should go to the customer organization that controls it.
Information we collect
Information you give us
When you request a demo, register for a webinar, or email us, we receive what you send: typically your name, work email address, organization, role, area of interest, and anything you write in your message. The Site’s demo form doesn’t store what you type. It prepares an email to us that you choose to send.
Information collected automatically
Like any website, the Site is delivered by servers that keep a log of requests. Our hosting provider, Amazon Web Services, records for each request:
- your IP address;
- the date and time;
- the page or file requested;
- the referring page;
- your browser and device type (user agent);
- the response status.
We use these logs to deliver and secure the Site, investigate problems or abuse, and understand overall traffic. They are deleted automatically after 90 days.
What we don’t do
The Site uses no cookies and no analytics, advertising, or social-media trackers. It loads no third-party scripts or fonts, and it doesn’t build profiles of visitors or follow you across other websites. See our Cookie Policy.
How we use information
- To respond to your requests, arrange and give demos, and follow up as a business contact.
- To send information about our products you’ve asked for. You can opt out at any time.
- To operate, maintain, and secure the Site, including detecting and preventing abuse.
- To comply with law and to establish, exercise, or defend legal claims.
We don’t use your information for automated decisions that have legal or similarly significant effects on you.
Legal bases (EEA and UK)
If you are in the European Economic Area or the United Kingdom, we process your information on these bases:
- Our legitimate interests in responding to business inquiries and running a secure website.
- Steps you ask us to take before entering into a contract.
- Compliance with legal obligations.
- Your consent, where we ask for it.
How we share information
- Service providers that process information for us under contract and only on our instructions. These include our cloud hosting provider (Amazon Web Services) and our business email and productivity provider.
- Professional advisers, such as lawyers and accountants, under duties of confidentiality.
- Legal and safety: when required by law or legal process, or to protect the rights, property, or safety of Fermata, our customers, or others.
- Business transfers: as part of a merger, acquisition, financing, or sale of assets, subject to this policy.
We do not sell personal information. We do not “share” it for cross-context behavioral advertising, and we do not use it for targeted advertising or profiling. We have not done any of these in the past 12 months.
How long we keep it
Request logs are deleted after 90 days. Correspondence and business-contact records are kept for as long as needed for the purpose they were collected for, such as the course of a business relationship. They are then deleted or de-identified, unless the law requires us to keep them longer.
Security
The Site is served only over encrypted connections (HTTPS). Information is stored encrypted, and access is limited to the people and providers who need it. No method of transmission or storage is perfectly secure, but we work to protect your information and will notify you where the law requires.
Your rights and choices
Wherever you live, you can ask us to access, correct, or delete the personal information we hold about you. You can also opt out of our marketing emails at any time by using the unsubscribe link or emailing us.
United States residents
Residents of California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, and other states with comprehensive privacy laws have additional rights, depending on where they live:
- To know what personal information we collect and how we use and disclose it.
- To access it, and to receive it in a portable format.
- To correct inaccurate information.
- To delete it.
- To opt out of its sale, sharing, use for targeted advertising, or profiling. We do none of these, so there is nothing to opt out of.
- Not to be discriminated against for exercising these rights.
California residents may use an authorized agent; we will ask the agent for proof of authorization. If we decline your request, you may appeal by replying to our decision with “Appeal” in the subject line. We will respond within the time the law allows. If we deny your appeal, you may contact your state Attorney General.
California disclosures
In the past 12 months we collected these categories of personal information:
- Identifiers, such as name, email address, and IP address.
- Professional information, such as organization and role.
- Internet activity, such as the request logs described above.
Sources, purposes, and retention are as described above. We disclosed these categories for business purposes only to the service providers listed above. We do not collect sensitive personal information, and we ask that you not include it in messages to us.
European Economic Area and United Kingdom
You have the right to access, rectify, or erase your personal information, to restrict or object to our processing of it, and to data portability. Where we rely on consent, you can withdraw it at any time. You may also lodge a complaint with your local data protection authority.
How to make a request
Email privacy@fermatadiscovery.com and tell us what you are asking for. We will verify your request by matching it to information we already hold, usually your email address. We respond within the time required by law: 45 days under most US state laws, and one month under GDPR.
Do Not Track and Global Privacy Control
The Site does not track visitors over time or across other websites, so it behaves the same whether or not your browser sends a Do Not Track signal. We treat a Global Privacy Control signal as a valid request to opt out of the sale or sharing of personal information. We don’t sell or share it in any case.
Visitors outside the United States
The Site is operated from the United States. If you contact us from elsewhere, your information is transferred to and processed in the United States, where data protection laws may differ from those where you live.
Children
The Site is intended for professionals and is not directed to children. We do not knowingly collect personal information from children under 16. If you believe a child has sent us information, contact us and we will delete it.
Changes to this policy
We will post any changes here and update the date at the top. If a change is material, we will highlight it on the Site before it takes effect.
